Capital Punishment A Form Of Legal Punishment Essay

Capital punishment implies that the criminal is sentenced to death as a punishment for their crimes. Prima facie, it appears to be the most just punishment and solution to crimes that demand such severity of punishment in proportion to the offense. However, the reason why it is a moot point and a debatable issue is because ethicists see both sides of the story and there are numerous ethical issues involved with institutionalizing capital punishment. To understand the debate on capital punishment as an ethical issue, there must first be an understanding of the terms involved in the debate. Capital punishment refers to death as a form of legal punishment for crimes. The term ethics refers to a code of human conduct that regulates human behaviour and helps one discern right from wrong. On the other hand, the employers in the collectivist cultural nations are found to maintain formal as well as informal relationship with the subordinates due to their emotional bonding (McWorthy and Henningsen, 2014). For instance, the management are found to be more personally connected with the subordinates outside the formal communication channel of the organisation. Hence, it can be seen that the superior-subordinate relationship in Australia and England is much stronger as compared to Asian countries, whereas the management of the organisations in these two countries only focuses on maintaining formal relationship in place of getting emotionally attached with the co-workers. Managing teams Team management is a key factor for the successful management of a large organisation that operates in different parts of the world. However, in terms of cultural, the management of team and the strategies of international HR managers vary from one country to another (Hansen, Hope and Moehler, 2012). In other words, cultural behaviour and practices of the managers plays an essential role in team management in various nations of the world. For instance, the people of Western cultures like to work individually as compared to the people of Asian countries (Glinkowska, 2016). Hence, the effort made by the management to work as a group or team is highly evident in the Asian culture as compared to the Western cultures. According to Glinkowska (2016), the people with high collectivist cultural marking are found to love working as a team. Hence, managing team in collectivist culture is quite easier due to the personal behaviour and psychology of the employees. As the employees with collectivist nature can adjust easily in a team, a higher level of productivity can be evident from group work. On the other hand, people from individualistic culture are more focused on personal goals and objectives. Irrespective of working in a group or team, the employees of individualistic cultures are intended to personal objectives and lack personal attitudes that is important to work in a team (Hansen, Hope and Moehler, 2012). Hence, the management of organisations in individualistic cultures need to make more effort in order to manage team work and influence the employees to work together for a common objective by keeping aside personal goals. On the basis of the above discussion and the Hofstedes Cultural Dimension framework, Australia and the United Kingdom falls under the same category of high individualism that makes it difficult for the management of the organisations in these countries to manage team work (Hansen, Hope and Moehler, 2012). However, with increase in the number of people from foreign cultures, a multicultural population has been formed in both the nations (Glinkowska, 2016). On the other hand, team work has emerged to be an effective strategy to seek success in the current competitive business environment. Hence, the management of the organisations in both the nations need to make a higher level of effort in order to influence the employees by establishing corporate culture to manage team work. Conclusion By considering the above analysis, it can be seen that the cultural similarities between Australia and England leads to a higher level of similarities processes and organisational culture in the firms in both the nations. Moreover, the process of communication, decision making, managing teams are in some cases similar in nature. Alternatively, there are certain differences in the managerial processes that can be evident due to the differences in masculinity, long term orientation and uncertainty avoidance. It can be seen that Australian organisations are more focused on short term goals, uncertainty avoidance and feminist power as compared to the management processes of the organisations in the United Kingdom. There are many recent immigrants from other countries in the European Union also. There are three regions in the federal state: Flanders in the north where the official language is Dutch; Wallonia in the south where French is the official language; and Brussels-Capital region where both languages are used. The smaller German-speaking community is in Wallonia. The regions and language communities enjoy autonomy in cultural and economic matters. My conclusion after these facts is that Belgium is not a homogeneous country with one national identity. As such, it is therefore difficult to give a general overview that applies to all Belgians. Another interesting difference we can find in the fact that the Walloons (French speakers) have culture similar to French. For example Walloon food is influenced mainly by French cuisine, less than the Dutch. Dishes are with relatively large portions and excellent quality. Widespread opinion is that Belgian cuisine is characterized by German portions size and French finesse and quality. But sometimes it tends to be spicier and higher in calories than modern French food. At the same time they share Belgiums national passion for soccer and etc. Only in Brussels, the capital, do the two groups coexist. Brussels is one of the rare officially bilingual capitals of the world. The beer culture in Belgium is unique and the country offers its visitors over 400 different beers and consequently there are a lot of tours and opportunities for tasting available for lovers of the drink. There are beer festivals throughout the whole year. Interesting stereotype is that Belgium brings beer, chocolate and waffles to mind. It is easy to forget the rich history and architecture of this country. The national dish is mussels with French fries. Even Belgians claim that the French fries are their invention. Also they have important table manner- the fork is held in the left hand and the knife in the right while eating, which have a great importance in their culture. Belgium does not have a lot of heroes, but they are proud of the tennis players Kim Clijsters and Justine Henin. All these facts lead me to think that it is difficult to know the Belgian Culture very well, but when you have such an opportunity you should not miss it. We also talked about the meaning of gestures in different cultures. Gestures are been used to replace words in many countries, and they are often specific for different cultures. Gestures may mean something complimentary in one culture, but something highly ottensive in another. Generally, there are no universal gestures. Nowadays with the influence of television and movies, some gestures have become more widely known and accepted in many countries. And in this intercultural world, if we want to succeed in international business and relationships, we should be aware of these differences, understand, respect and accept them. To many, these misunderstandings can still be quite offensive, not Just momentarily annoyances. Sometimes innocent actions can lead to very bad consequences. So before you travel, especially when it comes to exotic destinations or the trip is business directed and your career depends on it, you better get to know the habits and customs of the local people and be prepared so you know what behavior should to exhibit. I will give some examples like the sign for 0K (when your thumb and forefinger are making a circle). If you are an English- speaking it means good, French understands it as zero or worthless and Japanese ould read it as money. But you shouldnt show this to a Northern Greek. Understanding the cultural differences is important to avoid misinterpretation of gestures and misunderstanding of the other persons feelings and intentions. Most Europeans like to stand physically close to the person whom they are having a conversation with, much closer than the Westerners. Consequently, Westerners think the Europeans are pushy while Europeans think the Westerners are reserved. Other interesting knowledge was about the cultural competence and different ways to enhance it. We should all be treated equally, no matter what culture we are. This could include learning about traditions, beliefs, meaning of words, phrases, gestures, customs, activities and rituals. Lots of different cultures have different languages and rituals. Cultural competence involves continually developing your awareness of your own and others cultures. Often what is considered an appropriate behavior in one culture is inappropriate in another one. By increasing awareness of cultural differences and the breaking down of tereotypes and prejudices, we can help to develop tolerance and understanding between nations. During the lecture we discussed the iceberg model of culture. This comparison is because like iceberg, the culture has both visible and invisible parts. Elements of the culture which we can plainly see, such as food or clothes, are represented by the upper portion of the iceberg. Those elements which are not as obvious such as why someone eats or dresses the way they do are represented by the much larger portion of the iceberg underwater. l Communication in an international environment requires special training, consistent with the differences n national cultures. Each country has its own rules of behavior that determine the proper etiquette. Although foreigners are very tolerant of our mistakes and give them to ignorance they will be pleasantly surprised if one demonstrates some knowledge in this direction. This will cause them to respect him and show sympathy, and this can be a decisive factor in establishing long-term relationships. If you want to understand other cultures study them. This can be done not Just by reading about them, but also by participating in the customs and act according to the specific rules. Many people learn more than one culture, and managed to do well among them. When circumstances require people should be able to pass easily from one culture to another. Cultural ditterences are at the root ot many misunderstandings in communication between people of different nationalities. Members of a certain culture rarely see anything beyond their own and reasonable view of things. I think the most important thing when you have to deal with different culture is to overcome the cultural shock. At the beginning you are excited about all the new things around. But at the next moment you are disappointed and dissatisfied. In fact, it turns out that you do not know anything about the new culture. Finding things that you do not know is exhausting, though quite exciting. Disappointments are unavoidable, and unavoidable are the mistakes that you make in the beginning. After a little period of time you feel free to move in the other culture and learn not to have problems with the different beliefs, attitudes and values, and behavior, which they suggest. However, this soon came to an end, this was due to the fact that Whites believed they were losing their control, so something had to be done; and so began the Jim Crow laws. This was another idea that seemed to pose as a possible origin of the Jim Crow Laws, the fact of religion. Religion is something that may always have influence over the occurrence of an event. However, I don’t believe that this idea comes with as much support as the idea of Whites fearing the demise of their power. I believe that the reason these laws gained so much momentum was due to the fact that for years after the Civil War, racial mixing was allowed and seemed to be a common event. â€Å"The U.S. officially ended slavery with the passage of the Thirteenth Amendment in 1865. There were various proposals to grant freed black slaves compensation, or at least assistance in establishing themselves as free citizens† (Reconstruction, 2008). I think that Whites were angry about the way that things were happening and that they felt that their power was being undermined. So when the Jim Crow laws started up, the Whites had their vengeance and they wanted to take the power back. â€Å"Virtues are civic to the extent that they contribute to, and strengthen, the communal good† (Segregation and Civic Virtue, 2012). Segregation is usually thought to be an obstruction of the peace for a group of people. However, it can also be seen and expressed as a fact of strength. When doing some research I found a  couple of examples of the virtues of segregation in a community, â€Å"Obvious examples might include the building and maintenance of parks, schools, community centers, and libraries† (Segregation and Civic Virtue, 2012). These examples go to show that segregation may actually have some positive externalities on a community. Segregation can cause a community to be more verbal and communicate more on issues that would ultimately boost the morale of a community. There was one other sort of virtue that I found came about due to this era, and that was the Harlem Renaissance. This period was when group of gifted black authors published literature of their experiences during this rough time. These works of art would end up sticking with us, and continue to influence modern literature today. I don’t personally believe that there was much mutual respect between the races during this era. There may have been some respect present, but it was not the same by any means. I believe there were few, but some, Whites that respected the black race due to the treatment they had been put through. I also believe that some of the Blacks respected few of the Whites, mainly because of the rank of their status or the positions they held. However, these are two different views on respect and it seems to me that they are not based on mutual terms. The lack of mutual respect is something that I believe could be blamed for the hindrance of intercultural communication at this time. This also has to do with the fact that white people determined that Blacks were like children. They did not treat them with the same respect that you would treat another adult. This sort of treatment greatly affected the communication between Blacks and whites; Blacks were not considered to have valuable input and therefore their opinions were not taken into consideration. Blacks were treated as children and this is one of the sole reasons I think there was a large barrier to communication. After doing some research, I learned that Blacks would become spies in the Civil Rights Movement. According to State of Siege, â€Å"They paid money to black Mississippians to infiltrate the meetings of civil rights activists† (Mississippi State Sovereignty Commission, 2013). I believe that this quote is reason enough to explain why some Blacks held these kinds of positions. At this point many African American’s were going through tough times and were not given many job opportunities, there was a limited source of income and they knew they had to take advantage of each opportunity. This time in  our history can be looked upon to greatly define our nation. It shows how we have overcome a lot of struggles through our lifetime yet we still have our imperfections. The Jim Crow laws created a staggeringly large barrier when it came to communication between Blacks and Whites. Another factor that seemed to add to this miscommunication was the Citizen’s Council, which was basically just a large group of organized Whites that opposed civil rights. These are two of the reasons I believe that intercultural communication was lacking at this time; the Jim Crow Laws and the Citizen’s Council both showed a group of people who opposed the integration of Blacks and Whites. The people in this council and those who supported the Jim Crow Laws didn’t want to try and make opportunities for all men equal. They didn’t want to communicate with a group of people that was different than they were or of a different culture; I think that this led the way for others not wanting to change the way things were sooner. Sucheng Chan essays Sucheng Chan, the author of  ¡Asian Americans, an Interpretive History ¡, is currently a professor of history and is also the chair of the Asian American Studies Program at the University of California, Santa Barbara. In 1973, she earned her Ph.D. from the University of California, Berkeley. Not only a scholar and a professor, Chan is also an author. Her extraordinary work as a professor and a writer helped her win in prestigious awards in the literary community, such as the 1986 Theodore Salutoes Memorial Book Award in Agricultural History, the 1987 American Historical Association Pacific Coast Branch Book Award, and the 1988 Association for Asian American Studies Outstanding Book Award. Another award Chan has received in recognition of her academic work is a Distinguished Teaching Award from the University of California at Berkeley in 1978. With so many years of experience, Chan, in my opinion, satisfied the scholarly qualifications for my writing about her book. The book  ¡Asian Americans, an Interpretive History ¡ starts with the very beginning of time when the people from China, Japan, Korea, Philippines, and India first immigrated to the United States. Throughout this book, Chan talks about the accomplishments and struggles of the Asian Americans from the mid nineteenth century to the late twentieth century. Chan ¡s main focus or main emphasis is the impact Asian Americans have on the history of the United States, whether it is political, agricultural, or economical. Furthermore, despite the endless struggles Asian Americans had in the past, Chan also mentions the improvement of the status of Asian Americans over the past few decades and the decrease of racial inequality in this country. However, she ends with the intention of urging everyone, regardless of his/her race, gender, or ethnicity, to work steadfastly towards the curtailment of the racial tensions. ...

Soldiers don’t have as much sympathy for the people who are dying it’s almost as if they really don’t care but being that must be kind of necessary for a soldier because you can’t really sit there and cry over a friend who is dying while your enemies were slowly creeping up on your base. No fancy duds. No politicized preaching. No denominational hair-splitting. It’s come as you are in spirit, spurs and Stetsons. It’s bucking bulls and plumbing Bibles in a dusty arena or dropping a hard-won dollar in a boot on the back table after a punchy sermon. Ban Smoking On College Campuses Essay

For every eight smoker’s tobacco kills, one non-smoker is also killed by second hand smoke. ´(American Lung Association) With a fact like that, it makes one really think about where they have been and how much smoke they have been subjected to. For me, attending college every day and walking through clouds of smoke to get from class to class really begins to put my health into perspective. Should a public place such as a college campus receive more rights than a facility such as a restaurant, department or grocery store? With an individuals health rights, the cleanliness around campus, and overall irritation of some of the students at risk, I believe college campus’ should become America’s new target against smoking and become smoke free. When something starts to validate an individuals health rights, issues will be brought up. Smoking is something that America has discovered more and more about over the years and has found increasing numbers of facts about diseases and problems associated with it and the pollution it emits. Anyone who passes by a smoker can inhale the excess smoke and potentially be affected. Slowly, second hand smoke is something we are starting to become more aware of and businesses around America are starting to crack down on banning smoking in their facilities. College campus’ have not been hit by this new ban, though, and continue to let students crowd around their doors to get a smoke in between classes. Because the students tend to crowd around the doors, students entering or exiting the building inhale the smoke. Personally I am an individual that does not smoke so I really do not have any desire to incur any of the dangers that are associated with it. Also because college campuses are where students spend the majority of their day, avoiding contact with it is almost impossible. According to the US Dept. of Health, second-hand smoke has much higher levels of tar, nicotine, and carbon monoxide than the direct smoke a smoker inhales. â€Å"The Federal Environmental Protection Agency has classified second-hand smoke as a Group A carcinogen. This category includes only the most dangerous cancer-causing substance, such as asbestos and radon.† (American Lung Association) The potential effects of second hand smoke are a lot more dangerous than people expect, and the build up from inhalation can lead to serious problems for individuals in the future. Just by simply passing by a smoker and taking a  breath in and out, over time can cause damage. If this becomes an everyday routine, as one walks to and from his/her class each day they are at risk for potential problems from second hand smoke. Everyone has the right to smoke once they’ve reached the legal age, and I have no desire to discriminate against them, but if they choose to jeopardize their health it should have nothing to do with a stranger just passing by as they enjoy. A possible drive or smoke before or after they attend school might be a solution just as long as the individual isn’t on campus. Also, with smoking, cleanliness of the campus becomes an issue. For smokers, big cement ashtrays are set up outside to collect the excess cigarette when the individual is done smoking it. These ashtrays often are not given a second glance and the cigarette butts are thrown on the ground around the campus doors. The sight of cigarette butts strewn along the sidewalks around campus is disgusting and does not do much for the lawn attempting to grow along it. When the ashtrays are used, the smell of smoke emanates from them. Pollution from the cigarettes is also an issue, whether it is coming from the cigarette and the individual smoking it outside, or from the ashtrays. Smoke from anything causes damage to our environment and pollutes the air around it, but with cigarette smoke especially, chemicals are being emitted into the atmosphere as well. Persecution against smokers has never been my goal but when the place where I spend the majority of my day becomes a slight dumping ground for smoking, I believe some alternative needs to be made. Possibly, areas set up away from the campus specifically for smokers could be created so as not to punish college smokers but to keep the cigarette pollution in a confined area. From some of the problems that are surrounding smoking on campus, some students have begun to get irritated. Author, Lydia Sax states, â€Å"Smoking is on the rise, physical and emotional self confidence is down, and feelings of stress are up,† for college students. We all understand that smoking relieves stress for some but with the number of smokers on college campuses, non-smokers are starting to become affected. After walking in from outside, clothes tend to smell of smoke and those allergic to the particles become affected. Issues may be minor and tolerable to a point but when instances of  individuals who do not have any desire to be affected by smoke become more and more frequent, students want a change. Second hand smoke is dangerous and the affects of smoke have only disadvantages. I think everyone is aware of the effects of smoking and those who chose to ignore them, choose to ignore them. But for those people that choose not to be affected, second hand smoke can be very irritating. With the awareness of the dangers smoking causes, companies around the world are working to no longer allow it in their buildings. The dangers of second hand smoke and the irritants of it have finally become truly noticed. College campuses are still allowing it, and it is affecting the students. With issues concerning an individuals health rights, the cleanliness of the campus, and irritation of students, I feel that smoking should be banned from campuses. Everyone has a right to choose what or what not to subject themselves to, because second hand smoke has been proven to be just as harmful as first hand, for some people that right has been revoked.

With no doubt, chemicals are really harmful for human beings. As people all know that, toxic chemicals are used in the industries, which have to be safely covered and provide very serious use instruction, such as wearing long gloves, safety shoes or masks. However, even the chemicals are under several instructions, but people may have made some serious mistakes which caused a huge damage and large amount of death to people. In this essay, I am going to write about the two disasters that caused a lot of injures by the explosion of poisonous chemicals, which located in India and Italy. According to Shrivastava (1996), on the night of 2/3 December 1984, an enormous accident happened in Bhopal, India, the highly poisonous and unbalanced chemical gas was escaped from the factory and continue to spread over the city which caused by the lack of the attention and care ness. Apart from that, Marchi and Funtowicz and Ravetz (1996) states that in the 10 July 1976, a powerful weed killer which named 245T was exploded in a small town which located near Milan, the 245T contained the most powerful and toxic chemicals, it can kill any live stocks and human very easily, the accident was caused by man made unmanaged instructions and the toxic dioxin was spilled to the atmosphere. Between these two accidents, they were all caused by people not nature. Unlikely, these two took places in different period and locations. Luke (1984) believed that the Bhopal accident was caused by the ignorance of experts. This factory was built in a crowded population environment, and because they against the rule of US safety standard, too much amount of MIC was contained in the store and due to the huge quantity of it, the tank was not strong enough to hold the chemical, as the safety manual required at o degree, the safety system was broken down and water leaking in to it and set off the reaction. The chemicals were released into the air. Bhopal and Seveso were similar in that, according to Marchi Funtowicz Ravetz (1996) because of the unmanaged instructions and the ignorance, the disasters had a substantial damage and effect. According to Gail (2003), the Indian Government made a great effort in trying to manipulate the situation, yet all their attempts failed to provide the sufficient supply of medical services and food supply. There was not enough place for all the injured people to get medical treatment. That is because of the large number of injuries and the lack of doctors and medicine. Added to this, doctors at Bhopal had no idea of what kind of affection they were dealing with. Unfortunately, most people arrived at the hospital when it was too late, others died while waiting for their tern to see a doctor. Similar to Bhopal, Seveso suffered from lack of immediate responses and from ignorance of what exactly happened and what gases were released. Late decisions of evacuation and other responses were made, after the government first move of realizing and defining the accident and its possible consequences. B. De Marchi, S. Funtowicz, and J. Ravetz (1996), believe that Seveso had a better response than Bhopal, when a comparison between the two disasters were made. The Italian Government had more ability to absorb the affects in a shorter period of time. Unlike Bhopal, the process of recovery was reasonably good, due to the smaller affects, less damage and the high financial capability. There were compensations to victims, redeployment to people lost their jobs and there was some control on health long-term effects by monitoring them through a practical planned program. The main difference between the effects of the accidents at Bhopal and Seveso is that many people died at Bhopal, whereas there was no any death cases reported in any article at Seveso. Death is considered a short-term effect. David (2002) believes they were roughly 7000 death cases at Bhopal. Baines (1993) mentioned other short-term effects at Bhopal such as difficulty and eye irritation. Similar symptoms appeared on Seveso survivors. Added to this, Shrivastava (1996) points out that people exposed to the released gas had some other short-effects such as cough, vomiting and chest pains. Long-term effects at Bhopal mainly were eye-sight weakness and high possibility of getting different kinds of Cancer. No long-term effects are in detail in â€Å"The long road to recovery†, (B. De Marchi, S. Funtowicz, and J. Ravetz 1996), neither in â€Å"Environmental Disasters†, (Baines 1993). These disasters had involved so many people, some were dead, and some were seriously injured . Also, some people may have a great risk of getting the negative effect in their rest of lives. Due to these happened , there must be someone stand up and taking the responsibility for the huge damages and waste . In the disaster of Bhopal , the company which involved in was union Carbide , this company in USA was decreased their value of stocks by this failure. Furthermore, the Union Carbide in India has to accept to pay the funding for the patients and for the damages. Even though, the American company against to accept the legal responsibility which done by themselves. First of all, according to the articles, local government had legislate some issues for caring the chemicals and warning people who were working with the chemicals must pay a lot of attentions on it. Also, the companies which producing the chemicals have to be located far from the high proportions of people in the neighborhoods and providing the knowledge for hospitals about how to cure the chemical disease. In conclusion, every one and society have to do something to avoid the disaster happen, because no one wants to die or wants to see other people dead. So, from these two disasters, People have studied how to prevent the disaster happen, and not just blame some one to take responsibility after the disasters.
